Complicity in Criminal Act?
Dear Mr. Bandarin: Obviously the recent deliberations and protests over listing of Preah Vihear as a World Heritage site under Cambodian auspices has been a matter of concern to all of us. I would like to underscore the potentially criminal nature of the Thai foreign ministers commitments in this matter, specifically to the Thai Constitutional court ruling on 8 July 2008 that Mr. Nappadon was not authorized to make any commitment as he had in May. Because he was not authorized, it follows that any such agreement or commitment must be deemed to be null and void. Further, it logically follows that the courts position must be recognized by all concerned and the May 2008 agreements/commitments be nullified. There appears to be certain vested interests involved in all of this, resulting in some sort of consensus to get the matter resolved as soon as possible. There is a great deal of sentiment, not all of it merely nationalist in nature, that calls for the restoration of Thai sovereignty to land around and under Preah Vihear, such sovereignty surrendered, or attempted to be surrendered, by Mr. Nappadon. If UNESCO continues to proceed with what appears to be a contrived effort by vested interests (illegal as well) in Thailand to finalize this matter in Cambodias favor, then other issues may become far more complex. It is thus with the best of intentions and highest hopes that I appear to UNESCO to re-evaluate the World Heritage decision to award Cambodia sovereignty over Thai territory under the misinformed and misdirected efforts of Thailands foreign minister who acted without authorization and against the countrys constitution
surely such an act cannot be recognized by UNESCO. Sincerely, Frank G Anderson Founder, the Korat Post
AMNESTY INTERNATIONAL PRESS STATEMENT
Embargoed until 10.30 GMT Friday 20 June 2008 (12.30 Madrid)
World: Call for action on World Refugee Day 20 June In this, the 60th anniversary year of the Universal Declaration of Human Rights (UDHR) on World Refugee Day, Amnesty International calls on states to reaffirm everyones right to seek and to enjoy asylum from persecution, as recognized in the words of article 14 of the UDHR. Almost two million Iraqi refugees, fleeing murder, kidnap, torture and ill treatment, are now living in Syria and Jordan. In the Mediterranean region, asylum-seekers and migrants continue to die in the sea in their desperate attempt to reach Europe. These are two of the many refugee problems that confront the world today. Meanwhile, doors are being quietly closed. People fleeing Iraq now face visa restrictions as they try to enter Jordan and Syria. Sweden, host to the largest number of Iraqi refugees in Europe, has now changed its approach and is returning refugees to very dangerous areas of their home country. In the Mediterranean region, European Union countries such as Spain and Italy are involved with interception operations and joint migration control measures with countries in North and West Africa. People are being sent back to the terrible situations they were desperately trying to escape. International assistance for Iraqi refugees in Syria and Jordan is desperately needed, contributions to UN agencies working with refugees from Iraq inadequate. In May 2008, the United Nations High Commissioner for Refugees (UNHCR) made a fresh appeal for increased funding for its Iraq work. They cited a shortfall of $127 million for assistance programmes without which essential health and food assistance programs may have to be reduced, forcing many Iraqis into further destitution and raising the likelihood of higher malnutrition rates and increased rise of child labour. A total of 147 states are parties to the 1951 Convention relating to the Status of Refugees (the Refugee Convention) or its Protocol - the main international instruments protecting refugees. Amnesty International calls for world governments to ensure that their actions and policies do not undermine the protection offered by the Convention and other international instruments. Amnesty International also believes that states should not only protect the rights of refugees within their jurisdiction but should also help other countries dealing with large scale refugee situations. Amnesty International calls on the European Union to fully respect its obligations towards refugees, by ensuring that its border controls do not directly, or indirectly, force asylum-seekers to return to transit countries where they would be at risk of arbitrary detention, collective expulsion, refoulement - - as in the case of a number of countries in North and West Africa - - even the risk of being dumped in the desert without food or water. The organization also calls on the European Union to ensure that in the development of its common asylum system, all asylum-seekers under the jurisdiction of its member states have access to fair and satisfactory asylum procedures regardless of their country of origin or transit, and that the use of inadequate accelerated asylum procedures is ended. Amnesty International urges states to increase the use of resettlement as one of several responsibility-sharing tools to relieve the burden of receiving states and to provide refugees with a durable solution. For many refugees, it is the only way to ensure they have access to basic rights such as education, health care and adequate housing. For some, their illness, disability or trauma means they do not have access to adequate care in their countries of asylum. Only nine countries have traditionally had large resettlement programmes; these have been recently joined by developing countries such as Chile, Burkina Faso and Brazil, which have started to resettle small numbers of refugees. Amnesty International calls on other states to join this list. Finally, Amnesty International urges states, in cooperation with UNHCR, to develop an effective way of sharing the responsibility for large numbers of refugees, as and when urgent situations arise. The answer to this grievous problem cannot be to countenance human suffering and turn our backs on people in tragic circumstances. It is to take more responsibility for this global problem in a global way. URGENT
Khao Phrea Viharn, Thailand/Cambodia Your Excellency: This is to bring to your urgent attention a probable conflict of interest on the part of former and current Thai government officials in recent so-called negotiations and agreements between Cambodia and Thailand in reference to the status of ruins at Khao Phrea Viharn and surrounding area. Although recently Thai Foreign Minister Noppadon Pattama has indicated agreement between Thailand and Cambodia on the status of land adjacent to the ancient ruins, many of those outside government circles have expressed extreme misgivings and offered conflicting evidence that indicates Thai land being wrongfully shown as either within Cambodia or being given to Cambodia by recent vested interest agreements. There are strong indications, currently being reinforced by firm evidence and forwarded to government agencies for legal filings, that former The prime minister Thaksin Shinawatra has literally agreed to give away Thai land to Cambodia for personal commercial quid pro quo, namely right to build casinos and resorts, etc., in Cambodia. Recent press reports have confirmed Thaksins imminent financial involvement in this regard. Thaksin has been identified as regularly undermining the interests of his own nation for his personal benefit, without regard to human rights or the losses incurred by Thailand arising from his actions. The current Thai government acts on the behalf of Thaksin. This is to kindly request UNESCO to kindly consider this matter of recent Thai government agreements with Cambodia on Khao Preah Viharn in terms of both legal and ethics compliance. While it is understood that ENECSO must work with the legitimate governments of the nations it deals with, nonetheless UNESCO owes it to those nations and to UNESCO itself to ensure that agreements have been open and transparent and do not pose serious conflicts of interest between national leadership and the interests of each nation. It is important, vital, that UNESCO proceed in this matter with insistence on above-board procedures and fair and just open discussion of issues on a public level in each jurisdiction. I hope that UNESCO will issue some sort of policy statement on this matter, and perhaps underscore that UNESCO itself will to the best of its ability to safeguard the interests of countries involved in such important joint matters.
Sincerely, (Concerned observer)
Article 190 of Thaland's 2007 Thai Constitution
Section 190. The King has the prerogative to conclude a peace treaty, armistice and other treaties with other countries or international organisations. A treaty which provides for a change in the Thai territories or the Thai external territories that Thailand has sovereign right or jurisdiction over such territories under any treaty or an international law or requires the enactment of an Act for its implementation or affects immensely to economic or social security of the country or results in the binding of trade, investment budget of the country significantly must be approved by the National Assembly. In such case, the National Assembly must complete its consideration within sixty days as from the date of receipt of such matter. Before the conclusion of a treaty with other countries or international organisations under paragraph two, the Council of Ministers must provide information thereon to the public, conduct public consultation and state information in relevant thereto to the National Assembly. In such case, the Council of Ministers must submit negotiation framework to the National Assembly for approval. Upon giving signature to the treaty under paragraph two, the Council of Ministers shall, prior to give consent to be bound, facilitate the public to get access to the details of such treaty. In the case where the application of such treaty has affected the public or small and medium entrepreneurs, the Council of Ministers must revise or render remedy to such effects rapidly, expediently and fairly. There shall be a law determining measure and procedure for the conclusion of a treaty having immense effects to economic or social security of the country or resulting in the binding of trade or investment of the country significantly and the revision or rendering of remedy to the effects of such treaty with due regard to the fairness among the beneficiaries, the affected persons and the general public. A matter arising from the provisions of paragraph two falls within the jurisdiction of the Constitutional Court and the provisions of section 154 (1) shall apply mutatis mutandis to the referring of the matter to the Constitutional Court.

Scrapped Taiwanese Longline
Vessels A Boon for Sea Turtles
Environmentalists and Scientists Urge the UN and Other Nations to
Follow Suit with a Moratorium in the Pacific
October 17, 2005
Contact:Robert Ovetz, Sea Turtle Restoration Project, PhD, +1 415-488-0370
x106, robert@seaturtles.org
Forest Knolls, California The Taiwanese government has just announced
that it will dismantle 120 tuna longline vessels, about 5% of its
fleet. Environmentalists are praising this reduction in the largest
longline fleet in the Pacific as a boon for sea turtles which are
injured and killed by longlines in large numbers in the Pacific
ocean. "Longline fishing is costly, inefficient and damages
tuna fisheries. There are just far too many boats chasing too few
fish and killing far too many sea turtles," said Robert Ovetz,
PhD, Save the Leatherback Campaign Coordinator. It is estimated
that more than 1.4 billion longline hooks are set in the world's
oceans every year. Longline fishing is a technique in which thousands
of baited hooks are strung on monofilament lines stretching as far
as 60 miles. Taiwan has the largest number of longline vessels in
the Pacific with an estimated 2,113 vessels in the Pacific alone.
Japan, which has the second largest longline fleet in the Pacific,
has also followed suit with reductions in recent years. This summer,
The U.S. even banned fishing for Pacific bigeye tuna for the rest
of the year because of overfishing. "Fewer hooks means fewer
turtles, sharks, seabirds, billfish and marine mammals will be killed.
This is urgently needed if we are to turn around the descent of
sea turtles and albatross seabirds into extinction," Ovetz
added.
Recent scientific reports warn that the 100 million year old Pacific
leatherback sea turtles, whose female nesting population has collapsed
by 95% since 1980, could go extinct in the next decade. Nineteen
species of seabirds, including the black-footed albatross, are also
threatened with extinction by longlines. An estimated 4.4 million
turtles, sharks, seabirds, billfish and marine mammals are injured
and killed every year by longlines in the Pacific. Other reports
have pinpointed longline fishing as causing an 87-99% decline in
large pelagic fish in the Atlantic, Gulf of Mexico and the Pacific.
1,007 international scientists from 97 countries are urging the
UN to implement a moratorium on longline fishing in the Pacific
Ocean to prevent the extinction of the critically endangered leatherback
sea turtle. The scientists are joined by 281 non-governmental organizations
from 62 countries. The list of signers includes famed primatologist
Dr. Jane Goodall, biologist E.O. Wilson, oceanographer Dr. Sylvia
Earle, a National Geographic Explorer-in-Residence, and former U.S.
astronaut Bernard Harris, Jr. M.D. "While a good first step,
a moratorium is needed in order to have time to put into place further
reductions in fishing capacity and other conservation measures,
such as time and area closures, reductions in subsidies, 100% observer
coverage and controls on illegal fishing," Ovetz said.

Democrats Abroad Launch Final Push to Register
American Voters
Former US Ambassador to Thailand
William Itoh lends weight to effort
Democrats Abroad-Thailand and Americans
Overseas for Kerry (AOK) welcomed William Itoh to Bangkok August
20, 2004. Mr. Itoh, US Ambassador to Thailand from 1996-1999, is
lending his support as a member of Ambassadors for Kerry to a global
effort to encourage Americans living outside the US to vote. Ambassador
Kerry spoke briefly regarding the close friendship between Thailand
and the US, stressed John Kerrys engagement with issues surrounding
the 1997-1998 economic and financial crisis, and reassured the audience
of about 60 Americans that Kerry remains a strong friend of Thailand.Gary
Suwannarat, Chair of Democrats Abroad-Thailand, announced the launch
of the organizations ad campaign to inform Americans that, no matter
how long they have lived outside the US, they retain the right to
vote.
The basic tool for registering is the Federal Postcard Application
(FPCA), available from US Embassies and Consulates. Online resources
simplify the process by making the FPCA available anywhere in the
world. Diana Kerry, Chair of Americans Overseas for Kerry, has launched
a website funded by the Democratic National Committee to facilitate
voter registration for Americans living abroad: www.OverseasVote2004.com.
This new website enhances resources dedicated to providing voter
registration services for overseas Americans, the longest-running
of which is the US Government-administered Federal Voting Assistance
Program (FVAP) www.fvap.gov.
Voting in each US state is governed
by that states constitution and administered by state officials.
Each American living abroad has to contact her/his own particular
county election board.
These websites make it possible to pinpoint the right place to register
and vote. The first step is registration: Download the form; print
it out; complete it; sign it; and mail it. (Other online voter registration
tools require the individual to also download separate instructions
to obtain contact information for local election officials; the
new website automates this process.) Typically, a citizen receives
an absentee ballot in less than 3 weeks. Each voter must mail in
the completed and signed ballot by a deadline specified by the state
in which they vote.
These websites could result in
a substantial rise in the number of votes cast by the 4 - 6 million
American civilians living overseas. This roughly equals the population
of Massachusetts's, the US's 13th most populous state and home state
of John Kerry.
The presidential election in 2000
underlines the potential significance of overseas votes. Only 24.5%
of eligible adults voted for George Bush, while 24.8% voted for
Al Gore. Some 205,815,000 Americans were eligible to vote, three
quarters of whom were registered to vote. Two thirds of registered
voters cast ballots: an overall voter turnout of eligible voters
of only 51.3%. Turnout among American civilians living outside the
US, however, fell short of even that level: estimated at less than
40% in the 2000 election.
The number of overseas American
voters is equivalent to 3.8% - 5.7% of the 1.05 million Americans
who voted in 2000, compared to the popular vote margin of 0.3% in
the Bush-Gore contest. Some 18,000 Americans are believed to reside
in Thailand.
Online voting facilitation could
help mobilize these millions of voters to cast their votes and influence
the outcome of Americas November 2 general election. As well as
voting for president and vice-president, Americans will also elect
34 US senators, 435 Congressional Representatives, 13 state governors
and numerous state and local officials.

READ. WRITE. WIN.
The Ramon Magsaysay Student Essay
Writing Competition
Goes To Korea
The Ramon Magsaysay Student
Essay Competition (RMSEC) takes a bow in Korea this year,
under the auspices of the Ramon Magsaysay Award Foundation
(RMAF) and the Ewha Womans University (EWHA). This pilot of
the prestigious competition in South Korea follows its run
in the Philippines where the contest started in 2000 as a
way for the Magsaysay Award, Asias premier prize, to establish
a connection with the youth. For its launch in South Korea,
the competition invites participation from EWHAs 17,000 undergraduate
students by writing two- to four-page essays in English on
the theme, "Greatness of Spirit of Asian Women Leaders:
Personal Lessons From Magsaysay Awardees."
Thirteen (13) of 236 Magsaysay Awardees to date are from Korea,
three of them are women, all alumnae of the 118-year-old university
that is known as the worlds largest womens university and
an excellent ground for honing leadership among Korean women.
The three Korean women awardees are: Dr. Helen Kim (1963 awardee
for public service), Dr. Lee Tai-young (1975 awardee for community
leadership), and Mrs. Kim Im Soon (1989 awardee for community
leadership).
The Magsaysay Award, inspired by the "greatness
of spirit in selfless service to people" of the late
Filipino leader who championed the cause of democracy and
the common man during his time, has been honoring, since 1957,
the exemplary lives and achievements of individuals and organizations
across Asia. Through RMSEC, the awardees are held up as role
models among Asian youths. It is planned to go regionwide
by 2008. For the 4th cycle in the Philippines, RMSEC will
be launched in August during the Magsaysay Awards season this
year. The season is built around the birth anniversary of
the much-loved former president of the Philipines on August
31and is highlighted by the conferment of the years Magsaysay
laureates.
RMSEC in Korea is supported by ASIANA AIRLINES
which will fly in August the grand prize winner to the Philippines
for an all-expense-paid gift prize from RMAF. The Korean winner
will witness the conferment of the 2004 Magsaysay awardees
in August, attend the awardees lecture series, and immerse
in Philipine life and sites, particularly in Zambales, the
home province of the late president. Another sponsor, International
Herald Tribune-JoongAng Daily, which promotes the use of English,
offers two-week free subscriptions to registered RMSEC participants,
and will provide the grand prize winner and two runners-up
half-month exposures to the newsroom. All the finalists and
winners will receive handsome gift book sets in English from
RMAF.
